01 · Who this is between and how it is accepted

This agreement is between Killer Outreach LLC ("Killer Outreach," "we," "us") and the business named at checkout or on the invoice ("you," "Client").

You accept it by paying through a Killer Outreach checkout link or an invoice that refers to it, or by signing it. It takes effect on the day of that payment. The plan, price, market, and any add-ons named at checkout or on the invoice are part of this agreement, and so is the criteria sheet you approve at kickoff.

Where this agreement and the website disagree, this agreement controls. The Terms of Service and Privacy Policy cover the website, the calls, and the texts, and apply alongside it.

02 · What we do

We run targeted outbound calling in your name to put held appointments on your calendar. A real person calls a list we build for your market, and your past customers if you give us that list, from a number in your area code that shows your business name on caller ID. Every call is recorded and every outcome is logged.

When a prospect agrees to an appointment, we put it on your calendar, text them a confirmation, a reminder the day before, and a reminder the morning of, from that same number. You get one report every Friday with dials, conversations, booked, held, and the recordings, and access to your appointment desk for as long as the engagement runs.

We book the appointment. You run it. We do not quote your prices, sell your work, or take any fee tied to a sale.

03 · The plans

The plan you chose is named at checkout or on the invoice. Prices are per plan, not per show and not per lead.

Pilot. $8,500, paid once. Ten held appointments in 30 days, about 1,000 calls a week into your market. No setup fee. Dialing starts within five business days of payment and kickoff, and the 30 days run from the first dial. Includes one call-through of your past customers. Nothing is owed after the 30 days. If you move to a plan within 30 days of the Pilot's last held appointment, the plan's setup fee is waived.

Full Desk. $15,750 a month plus $2,500 setup. Fifteen held appointments a month, about 1,500 calls a week. Three months to start, then month to month.

Exclusive Desk. $29,500 a month plus $2,500 setup. Thirty held appointments a month, about 3,000 calls a week. Three months to start, then month to month. One company per niche per market, claimed first come: while your Exclusive Desk is active and paid, we do not run calling for another company in your niche in the market named on your criteria sheet, and we put your desk first on surge pushes such as storms, seasons, and launches.

Add-ons, available on an active plan: Reactivation $2,200 a month, Estimate Follow-Up $2,200 a month, Second Offer $3,800 a month, Storm Response $3,300 per event. The Install (we build the calling operation inside your business) is quoted in writing and invoiced in two halves.

Setup covers the list build, your number, your scripts, the calendar hookup, and the text sequences. It is paid once.

04 · The words

Booked. A date and time the prospect agreed to, on your calendar, confirmed by text. Every appointment starts here. A booked appointment is not what you pay for.

Held. The prospect, or the decision-maker on your sheet, was there at the agreed place and time, or on the call, for the appointment. This is what we sell, what we guarantee, and the only thing that counts toward your number. Held is about being there, not about what happened next. It also counts as held if your rep was late, lost, or absent, if you rescheduled it after booking, or if no outcome is reported within 72 hours.

No-show. Confirmed, reminded twice, and not there. It does not count. We rebook it or replace it free, as many times as it takes.

DQ. An appointment that did not meet a criterion on your approved sheet before the month started, where the miss is a fact about the prospect at booking that the recording or the appointment itself can show. It comes off your count and is replaced free.

Replaced. We book another appointment at no charge, from the same campaign. A DQ and a no-show are both replaced.

Rolled forward. If a month comes in under its number, the shortfall is added to the next month's number at no charge.

Criteria sheet. The one-page list of who counts, which you approve in writing at kickoff and which stays fixed for each month.

05 · The guarantee

Four cases, four answers. These are the remedies, and they are the only ones.

Did not meet the criteria you gave us. Replaced free.

Short of your monthly number. The difference rolls forward free. If you are still short at the end of your first three months on a Full Desk or Exclusive Desk, we keep dialing free until you have had every appointment you paid for.

Confirmed, reminded twice, did not show. Rebooked or replaced free, as many times as it takes. A no-show never counts toward your number.

Showed up, qualified, did not buy. Held. That is your close rate.

First week. If the first booked appointment is not on your calendar inside the first week of dialing, that week is free and the month starts over from the next one.

Pilot. If fewer than ten appointments are held in the Pilot's 30 days and you move to a Full Desk or Exclusive Desk within 30 days of the Pilot's end, your first month of that plan is free.

The guarantee holds while you keep the three conditions in section 07. If a condition lapses, the number pauses with it and resumes when the condition is back.

06 · What counts as a DQ

A criterion belongs on the sheet if the prospect can answer it yes or no on a call, or the list data already says it: owns the property or is the decision-maker or the decision-maker will be there; inside the zips or counties on your sheet; home, roof, or system age band, value band, property type; for business-to-business, title, industry, headcount, location; agreed to meet about the service on your sheet and not something else; wants the work inside a window you named; not a renter, not a recent customer, no open quote from you, not on your do-not-call list.

Never a DQ: did not buy, price shopping, or "just wanted the free quote" (the offer was a free estimate, and that is what they came for); budget, credit, or ability to pay, unless a budget question is on your sheet and we asked it; rude, difficult, or "not motivated"; changed their mind after booking (that is a cancel or a no-show, rebooked or replaced free, never counted); sold the house or hired someone else after booking; your rep was late, lost, or did not show; a criterion added after the booking or changed mid-month.

To claim a DQ, name the failed criterion within 72 hours of the appointment. We check the recording inside two business days. If it holds, the appointment comes off your count and the replacement is booked. If we never asked the question, that is our miss and it is replaced. If we asked and the prospect answered falsely, it is replaced anyway. The recording decides disputes. If more than a quarter of a month's appointments are marked DQ, we reopen the sheet together before the next one is booked.

07 · Your side of it

Three conditions. They are the same three on the pricing page and the guarantee page.

Outcomes reported within 72 hours. Someone on your side tells us what happened on each appointment within three days: held, no-show, rescheduled, closed. One word by text is enough. An appointment with no outcome reported after 72 hours is counted as held. A no-show reported inside 72 hours is rebooked or replaced; one reported later is counted as held, because we can no longer replace it inside the month.

Criteria unchanged mid-month. The sheet you approve at kickoff is what we book against for the month. Change it in writing at the start of the next one.

Calendar open as agreed. The hours and the people you gave us at kickoff stay available. If the calendar closes, the number pauses with it.

Also at kickoff, within five business days of payment: the criteria sheet, the calendar we book onto (yours or the rep's), the hours, the name of the person who runs the appointments, permission to use your business name on caller ID and in the texts, and your past customer list if you want that call-through. Dialing starts within five business days of payment and kickoff, whichever is later; if kickoff slips, the start date moves with it. If a prospect complains to you about a call, tell us the same day and we handle it, including a permanent opt-out across every campaign we run.

08 · Billing

Payment is by card or US bank debit through our checkout, or by invoice. Prices are in US dollars and exclude any tax that applies.

Pilot. $8,500 in full before dialing starts.

Full Desk and Exclusive Desk. The first three months plus setup are billed as one amount in two halves: half when you sign, half the day dialing goes live. Full Desk: $49,750 in halves of $24,875. Exclusive Desk: $91,000 in halves of $45,500. A Pilot that converts pays the same halves with setup waived: $47,250 in halves of $23,625 for a Full Desk, $88,500 in halves of $44,250 for an Exclusive Desk, the second half at the start of month two. From day 91 the monthly plan fee is charged automatically each month to the payment method on file until the plan is ended under section 09.

Add-ons are charged monthly with the plan. The Install is invoiced in two halves as quoted.

If the second half is not paid on go-live day, dialing does not start until it is. If a monthly charge fails and is not cured within five business days, dialing pauses; the paused days do not count toward your number, and the number does not roll while paused. Fees already paid are not refunded except as the guarantee says.

09 · Term and ending

Pilot. Dialing runs for 30 days from the first dial, or until the tenth appointment is held, whichever comes first. Appointments booked inside those 30 days that have not yet been held are still rebooked or replaced until they are, so the Pilot can run past day 30 for that purpose only. Nothing is owed after it.

Full Desk and Exclusive Desk. Three months from the first dial, then month to month. After the first three months either of us can end the plan by email at least ten days before the next monthly charge; the month already paid runs to its end. Rollover applies only while the plan is active. The free dialing after month three in section 05 applies if you stayed through the three months and kept the three conditions.

We may pause or end any plan at once, keeping fees paid, if payment is not cured, if you ask us to do something that would break telemarketing or recording law or ignore an opt-out, or if our staff are abused. You may end any plan at once if we materially fail to deliver and do not fix it within ten business days of your written notice; in that case we refund the unused part of the current month.

When an Exclusive Desk ends, the market is released.

10 · Calling in your name

You authorize us to say we are calling for your business, to show your business name on caller ID and in texts, and to describe your offer as written on the criteria sheet. You confirm that what you tell us to say about your business (licensing, insurance, warranty, the offer) is true, and that you will honor the offer with every prospect we book.

On our side: every list is scrubbed against the National Do Not Call Registry and the state registries that apply before a campaign starts; calls are placed between 8am and 9pm in the prospect's time zone; calls are recorded with the notice the law requires; opt-outs are honored across every campaign we run and kept on a permanent list; texts go only to people who agreed to an appointment and stop on STOP. We will change or stop any script line you ask us to. No prerecorded or artificial-voice calls, ever; a person places every call.

What happens at and after the appointment is yours: your rep, your estimate, your contract with the homeowner, and your own compliance from that point on.

Once you have your first booked appointment we may name your business as a client. We never publish your numbers or results without your written approval. You may name us as your appointment partner.

11 · Data and ownership

The appointments we book for you, and the prospect details on them, are yours. You get the recordings of your booked appointments, your desk for the life of the engagement, and an export of your appointments on request.

The lists we build, our scripts, our text sequences, our dialing data, and the phone number are ours. The number is yours to keep at cost if the plan ends and you want it. We do not sell your data, we do not give your prospects to another client, and on an Exclusive Desk nobody else in your niche and market gets our calling while your desk is active.

You use the prospect data we hand you in line with the law that applies to you, including do-not-call and consent rules for any calls or texts you send afterward. How we handle personal information is in our Privacy Policy.

12 · Confidential information and our people

Each of us keeps the other's non-public information private and uses it only for this engagement: your criteria, customer lists, pricing, and results on one side, our scripts, lists, methods, and pricing on the other. This survives the end of the agreement.

The setters and closers who work your campaign work for us. During the engagement and for twelve months after, you will not hire or contract them directly, or through anyone else, without our written agreement. If that happens, a placement fee of $10,000 is due.

13 · What is not promised, and limits

We promise held appointments and the remedies in section 05, and nothing more. We do not promise that any prospect buys, or any amount of revenue. Estimates of close rates given on a call or in a report are planning numbers, not commitments.

Our total liability to you under this agreement is capped at the fees you paid us in the three months before the claim. Neither of us is liable to the other for lost profits or indirect or consequential damages.

You are responsible for, and will defend us against, claims that arise from your services, your offer, your conduct at or after an appointment, or your use of the prospect data. We are responsible for, and will defend you against, claims that our calling or texting broke telemarketing law, where you followed the criteria sheet and what you told us about your business was true.

14 · General

This agreement, the checkout or invoice that names your plan, and the approved criteria sheet are the whole agreement between us. Changes are made in writing, including by email. We may post an updated version of this agreement with a new effective date; for a plan already running, the update applies from the next monthly renewal after we send you thirty days' notice, and never changes the price or the number of a term already paid for.

Neither of us assigns this agreement without the other's consent, except to a buyer of the business. We are independent contractors. Notices go by email, to you at the address given at checkout and to us at hello@killeroutreach.com. Acceptance by checkout, by paying an invoice, or by electronic signature is as binding as ink. If any part of this agreement cannot be enforced, the rest stands. Sections 11 through 13 survive the end of the agreement.

Georgia law governs, without regard to conflict of law rules. Disputes are brought in the state or federal courts in Richmond County, Georgia.
